These terms govern your use of this website and any order you place with DIVIANTE. By using the site or placing an order, you agree to them. Please read them alongside our Privacy Policy, Refund Policy and Shipping Policy.

Who We Are

DIVIANTE is a fashion house based in Miami, Florida, United States. You can reach us at support@diviante.com.

Eligibility

You must be at least the age of majority in your jurisdiction, and able to form a binding contract, to place an order.

Orders

Your order is an offer to buy. A contract is formed only when we send you a confirmation that the order has been accepted or dispatched.
We may decline or cancel an order — for example where an item is unavailable, where there has been a pricing or description error, or where we suspect fraud. If we do, we refund you in full.
We may limit quantities per customer or per order.

Pre-Orders

Items in the GENESIS collection are sold before they are in hand.

Payment is taken in full when you place the order, which secures your piece and your size.
Delivery is expected from January 2027. This is an estimate, not a guaranteed date.
You may cancel at any time before dispatch for a full refund.
If we cannot fulfil a pre-order at all, we will tell you and refund you in full.

Prices and Payment

Prices are in US dollars and may change at any time before you order. Payment is processed by our payment provider; we do not store full card details. You confirm that you are authorised to use the payment method you supply.

Products

We work to show our pieces accurately, but colours and finishes vary between screens, and items made by hand carry small variations. These are characteristics of the work, not defects.

Intellectual Property

The DIVIANTE name, the thorned-tree device, the D monogram, our designs, photography, text and the look and feel of this site are owned by us and protected by law. You may not copy, reproduce, or use them commercially without our written permission.

Acceptable Use

You agree not to use the site unlawfully, to interfere with its operation or security, to scrape or harvest data from it, or to attempt to gain unauthorised access to any part of it.

Third-Party Links

The site may link to services we do not control. We are not responsible for their content or practices, and their terms govern your use of them.

Disclaimers and Liability

The site is provided on an "as is" basis, and we do not warrant that it will be uninterrupted or error-free. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, for fraud, or any statutory rights you have as a consumer.

Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.

Governing Law

These terms are governed by the laws of the State of Florida, United States, and the courts of Florida have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence.
